Terms of Service

1. Acceptance of Terms

By accessing or using the Apex PM platform, you agree to be bound by these terms of service. If you do not agree to these terms, you may not use the platform. These terms apply to all users, including property managers, staff, owners, and occupants.

2. Description of Service

Apex PM provides a property management platform that includes maintenance management, guest registration, broadcast messaging, unit and occupant management, and related tools. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. Apex PM is not liable for any loss arising from unauthorized access to your account.

4. Acceptable Use

You agree to use the platform only for lawful purposes related to property management. You may not use the service to transmit harmful content, attempt to gain unauthorized access to our systems, or interfere with other users' access to the platform.

5. Payment & Billing

Paid plans are billed according to the pricing tier selected. Fees are based on the number of units managed and are billed monthly or annually. All fees are non-refundable except where required by law. We reserve the right to change our pricing with 30 days' notice.

6. Data Ownership

You retain ownership of all data you upload to the platform. We do not claim any intellectual property rights over your content. You grant us a limited licence to use your data solely to provide and improve the service.

7. Limitation of Liability

To the maximum extent permitted by law, Apex PM shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim.

8. Termination

Either party may terminate this agreement at any time. Upon termination, you may request an export of your data within 30 days. After this period, we may delete your data in accordance with our data retention policy.

9. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or through the platform. Continued use of the service after changes take effect constitutes acceptance of the revised terms.
